She can only qualify for the K-1 if she is your fiance, not your girlfriend. Student loans will not help for the affidavit of support. Find another joint sponsor; it does not need to be a parent or a relative. Your fiance is unlikely to be issued an F-1 student visa if she is engaged to a US citizen.

If your boyfriend is a US citizen, he can sponsor you under a K-1 visa as the fiancée of the US citizen. He would file form I-129F with supporting documentation to U.S.C.I.S. He could also marry you and file for your immigration through form I-130 petition for alien relative. The waiting time for a K-1 visa is probably nine months and for an immigrant visa probably about a year. If he is a permanent resident, he would only be able to sponsor you for an immigrant visa and the waiting time would likely be more than a year. As your boyfriend is unemployed and going to school, you would require a cosponsor for your financial support. If you have initiated proceedings with USCIS, you should be fine. By waiting on the lawyer, do you mean for the lawyer to file your papers or to receive notification back from USCIS? HB 87 is a state law and cannot trump federal law. It provides enforcement provisions for employers. Without knowing more, it is difficult to provide you with a detailed response.
