It seems as if the plan depends upon whether CBP believes that your entry under a B visa is for a short period of stay, and not a substitute to stay in the US for a long period of time in lieu of an H-4 visa. You can marry someone who does not have immigration papers. Check with the place where you are planning to get marries as all Cities have different rules for this. If you are seeking to get papers for that person the case may require that you obtain a Provisional Waiver. This can be complicated.
