Your mother could petition for you, but you would have to process your immigrant visa outside of the US and when you leave, you'll be barred from returning if you overstay your current visa by too long.   A waiver is available.  Of course, marriage to a US citizen would allow you to stay here and become a permanent resident (assuming you entered the US with inspection).

Normally when you apply at 3 years from obtaining your residency your marriage must be in good standing in order to receive your citizenship. If you apply at 5 years then your marriage does not come into play. If the USCIS determines you committed Fraud at the last application process you could have issues getting your Nat'l approved.
