Change of status from F2 to H4

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Although there is much comment that nonimmigrants should maintain a valid nonimmigrant status during the time that they are applying for another nonimmigrant status with U.S.C.I.S., I do not believe that that would apply to your situation in which both you and your husband filed H-1B/H-4 applications at the same time. I do not believe that you are required to do anything. You can still petition for your husband even though you have a criminal record, but you will need to show sufficient income or have a joint sponsor.

Will a legal separation cause my wife a problem getting U.S. citizenship?

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
She can keep her permanent resident status even after divorce.  If she has been a permanent resident for at least five years, she can apply for citizenship even if the two of you divorce.
