How can I get my mom a tourist visa to come to my wedding?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Best wishes with your upcoming marriage. The focus of your mother's visa application will be upon persuasively showing that she can be expected to return to her home country in compliance with the visitor's visa. Some of the following can be useful in this regard: evidence of home ownership or a residential lease abroad; evidence of a temporary leave of absence from employment for the purpose of the trip; evidence of other family members in the home country; evidence of bank accounts, automobiles, charge cards, etc. in the home country; evidence of a round-trip flight; and evidence of an invitation for her to attend your wedding. After you have become married, and assuming that there are no complications from you entering the U.S. on a J-1 visa with a two-year home residence requirement, you and your spouse may apply for you to adjust status to become a Lawful Permanent Resident (to get a "Green Card"). It would be wise to work with an immigration attorney for that process.

Shoplifting can affect a citizenship?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
In your fact situation, your case of shoplifting was in August 2015, well over five years old by the time that you applied for your citizenship in January 2022. I also note that you said that you received your permanent residence in 2017, and I assume that you disclosed the shoplifting offense in your immigration application papers. The period of good moral character is five years, and this should not be held against you. I suggest, however, that you obtain a certified copy of the court disposition to take with you to the interview if you have not already presented it as part of your naturalization application. On your other questions, I do not believe that pretrial intervention and dismissal qualify as one of the programs  mentioned in part 12, item 26, if you did not have to make an admission of guilt. Also you should mention the traffic tickets as item 23 of the same part asks whether you have ever been cited, and a traffic ticket is a citation. Due to the limitations of the Lawyers.com Forums, Alan Lee & Arthur Lee, Esqs.’ (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Would it be easier to get my fiancé a green card if we both go to Mexico and get married?

Answered by attorney Kenneth G. Wincorn
Immigration lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
He will require consular processing in Mexico. The wait may be considerable but there may be some relief coming in a few months. Contact an attorney to discuss.
