How long will the NVC take ?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
As the F-2A category for spouses of permanent residence is available for immigrant visa issuance where the I-130 petition was filed by September 8, 2013, your case is current and should be processed fairly quickly. In answer to your questions, the next steps after the payment of the invoices will be the NVC's instructing you and your husband to prepare documents including affidavit of support papers and send them to the NVC. If everything is all right, an interview could be scheduled within two – six months of sending in the documentation. Your husband will be interviewed at the location which is indicated for consular processing on the I-130 form. If your husband wishes a change of location, he should notify the NVC.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can I apply for my fiance to get to the US if I am a permanent resident?

Brian D. Lerner
Answered by attorney Brian D. Lerner (Unclaimed Profile)
Immigration lawyer at Law Offices of Brian D. Lerner
As long as there was no ruling of marriage fraud and the marriage is legitimate and you are not currently married to somebody else, you can begin the petition. However, it will take years unless you become a US Citizen. *Naturalization Application* The Naturalization Application must be filed. If done properly, it will take a few months to receive the fingerprinting notice, and then several more months to receive the naturalization interview to obtain U.S. Citizenship. Shortly thereafter, if approved, you will have the swearing in ceremony to become a U.S. Citizen. Please note that many people find themselves getting the application denied or being placed into deportation/removal proceedings because of past conduct.
