Can I marry my Filipina girlfriend when she visits here on a B2 visa so she won't need to go back to her country?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
In theory yes but her intent can't be to come here and get married and stay at the time she enters on the B-2. If this intent is formed after she gets here then yes you can get married and complete the process for her permanent residency while she is here on the B-2.

Can a US permanent resident sponsor his new spouse owing money to child support and probably having a warrant for it as well?

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
Your child support arrears may affect the case if you do not have the minimum income level that is required to financially sponsor your new spouse. If you fail to meet that minimum level you can solve that problem by getting a joint financial sposnor to help you.

Can I petition back my fiancée who has three charges?

Alan Rodolfo Diamante
Answered by attorney Alan Rodolfo Diamante (Unclaimed Profile)
Immigration lawyer at Law Offices of Alan R. Diamante APLC
He can request voluntary departure if he is not eligible for any other form of relief. It is important to determine if he has a defense to the deportation. Meanwhile, if he marries you and you petition him, he can do consular processing. However, if he had lived in the U.S. undocumented over a year, he will have to apply for a waiver. If he indeed gets removed from the the U.S. , he will have to apply for two waivers.
