How can I fix my husband’s papers after he got deported and came back to the US?

Answered by attorney M. Gabriela Ungo
Immigration lawyer at GC Ungo Immigration
Your husband would be subject to a "permanent bar" because he re-entered the US after being deported. He is also not eligible for a waiver. Sorry, but the only option I see is to wait for immigration reform :(

Hi I just want to know if i can apply a green card for my mother at this time. And i m also not working i m taking a unemployment thank you

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Under the current public charge rules, the income and assets of the petitioner are even more important than before. Factors to be taken into account are your past history of work, taxes paid in the past, prospects for work, assets, education, licenses, etc. You mother would also need a good cosponsor who could convince USCIS or the American consulate if mom is overseas that he or she would be willing to take up the support obligation. The current public charge rule is one that is undoubtedly on President-elect Biden’s immigration list to undo, but that will take some time as it was implemented as a regulation instead of as an executive order. Been arrested twice, once in 2003 and 2008. first falsifying police report and second fighting. Can i apply for citizenship with out any problems. NYC

Answered by attorney Doreen A. Emenike
Immigration lawyer at Law Offices of Doreen A Emenike
Hello,   It is not clear from your question if you were ever convicted as a result of these arrests or when you first obtained your green card. This is information which is very important when you wish to submit an application with the USCIS for it lets one know if you will be eligible for naturalization and also, to ensure that you do not inadvertently end up in deportation proceedings due to your criminal convictions. The USCIS will review the past five (or three years if you got your green card through marriage and are still married to your U.S. citizen spouse) in particular to see if you are of good moral character. If one's arrests fall outside of the 3 or 5 years preceding your application, then it is possible to file for naturalization without worry.   Notes: This information is of a general nature and is not, nor is it intended to be legal advice. You should consult with an attorney for specific advice for your case.
