Alabama attorney David Keith McWhorter was suspended from the practice of law in Alabama for one year effective February 7, 2012, the imposition of which was deferred pending a two-year probationary period. On February 7, 2012, Panel I of the Disciplinary Board accepted McWhorter's conditional guilty plea to violations of rules 1.4(b) and 1.15(a), (b), (d) and (j), Alabama Rules of Professional Conduct. McWhorter admitted that he failed to properly manage his trust account, comingled trust and attorney funds and failed to keep complete and accurate trust account records. He further admitted that he failed to reasonably communicate and follow up with his clients concerning their legal matters.
