About Mr. Richard Cazzell Deberry

I am board certified in Commercial Real Estate Law by the Texas Board of Legal Specialization. My litigation practice focuses on real estate, condemnation/eminent domain, construction law, railroad and commercial contract disputes. My real estate litigation practice also includes ad valorem or property tax disputes, purchase and development contracts and commercial landlord/tenant disputes. I bring more than 23 years of broad-based state and federal court litigation experience to the firm. During my career, I have represented the interests of industrial, commercial and retail property owners and developers, homeowners, ranchers, farmers, public school districts, municipalities, a private university and banking institutions. I also have considerable experience in railroad related litigation having represented both a major railroad as well as a short-line railroad in a variety of matters.  Over the years, my real estate litigation cases have involved office buildings, apartment and condominium projects, shopping centers, restaurants and medical offices and facilities. Condemnation cases I have handled have involved pipelines, electric transmission lines, county roads and state highways, toll roads, railroads, airports, public schools, county and municipal buildings, water districts and municipal drainage facilities. My property tax cases have involved commercial properties and office buildings, as well as owner representation in high value residential properties. My construction litigation practice focuses on owner representation in commercial/industrial and public construction projects, including troubled projects requiring management of general contractor, architect, or surety related issues, as well as owner representation in high value residential projects. In addition, my construction law practice includes drafting and editing construction contracts, architect and/or engineer agreements and consultation regarding best practices for larger projects and multiple facility construction programs. The railroad litigation part of my practice has involved right-of-way disputes, condemnation for new tracks and facilities, tariff/demurrage and other federal regulatory issues and union disputes. In general commercial litigation, I work primarily on contractual disputes, including insurance coverage disputes.
