Am I still a beneficiary because my brother was appointed executor for my mother's estate as well as my grandmother's?

Randall C. Romei
Answered by attorney Randall C. Romei (Unclaimed Profile)
Estate Planning lawyer at Ashcraft & Ashcraft, Ltd.
The validity of the Will could depend upon the circumstances surrounding the preparation and execution of your grandmother's new Will. The facts and the ability to prove the facts are important. Did your grandmother understand what she signed? Was she misled. If your mother died after your grandmother, then, as the beneficiary of your grandmother's estate, your mother's estate will receive its proper distribution pursuant to the terms of your Grandmother's Will. You must then look to the terms of your mother's Will to determine who would receive her estate. If your mother had no Will then your mother's children share in the distribution of your mother's estate. If your mother predeceased your grandmother, then the contingent beneficiaries under your grandmother's Will receive the distribution of your grandmother's estate.

How can I protect my financial assets from my drug addicted stepsons?

Answered by attorney Loren M Lambert (Unclaimed Profile)
Estate Planning lawyer at Arrow Legal Solutions Group, P.C.
You need to either jointly create a trust or separately keep your assets separate from your husband's and create a living or testamentary trust. It sounds like you have the means to consult with an attorney, it is foolish not to do so. Especially under your circumstances.

Don't I have a right to know what my dad's wishes were?

default-avatar
Answered by attorney Douglas Lee Bryan (Unclaimed Profile)
Estate Planning lawyer at The Bryan Law Firm L.L.C.
Yes, if your father had no will, in Louisiana, you and your siblings would be his sole heirs of his estate. Your step-mother would not be the one inheriting his estate. If she had any community property with your step-mother, you and your brother and she would now be co-owners of that community property, and you and your siblings would solely own his separate property.
