How does one stop a court proceeding?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
Your question is too complicated for this type of forum. There are two types of jurisdiction issues, personal and subject matter. One can be waived one cannot. You need to have an attorney review the complaint and status of your matter to advise you about your case.

Do we have to wait for my brother to sell my mothers home before reading the will?

His status as agent under a power of attorney died with your mother. Someone will need to be appointed personal representative in order to sell her house. Once someone petitions for probate and to be named personal representative, the will will be in the court's file for anyone to see. IMHO there is no reason for secrecy in handling the estate of a deceased person. Everything should happen in the sunshine, according to Oregon law and your Mom's will, and in that way everyone gets what your Mom wanted them to have and the whole family can stay friends.

How do I leave everything to my kids?

Answered by attorney Victor L. Waid (Unclaimed Profile)
Estate Planning lawyer at Law Office of Victor Waid
Assuming you have little or no assets, and did not acquire any community property during the current marriage, your children of a prior marriage would be entitle to receive everything unless you have jointly owned assets of any kind held with your present wife, in which case she would survive to those assets. You could draw up a will or have one prepared to accomplish your objective.
