Property does not go to the state unless there are no heirs and no will. That process is called escheat as in the word "cheat." Where there are heirs and he has no will, his property would, by statute, go proportionally to his wife and children. Only if he had no wife and no children would it then go to his parents, If he had no living parents, it would go to his brothers and sisters, and no brothers and sisters, it would go to his nieces and nephews.
