No, this will not work. You need to have an attorney prepare a general durable power of attorney form for finances and medical treatment. The attorney will know how to draft the form so that the people you are dealing with will accept it. It is very important that this be done while your husband (and you), still have the necessary capacity to do so. If you are past that point, then the probate court would need to appoint a guardian and conservator to act on your husband's behalf.

May I continue to probate my mother's estate?

If you have been appointed you are the Personal Representative unless and until you are removed. Did you use an attorney to assist you in Michigan, if not perhaps you should. In my view if the inventory is due before the hearing date, I'd file it and pay the inventory filing fee. I also recommend that you respond to your brother's motion regarding trying to remove you as Personal Representative, especially if you feel that you can perform the duties. That said, again, I think you need an attorney representing you now and at the hearing.

File a probate matter immediately ask that YOU be appointed the executor of the estate then you have the power to do the right thing.
