I have a trust but would like to make some changes, can this be done?

default-avatar
Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
You can change attorneys, without any problem. Whether or not you can amend the terms of the trust depends on the terms of your trust. It would be relatively unusual for the trust to be irrevocable, but it is possible. Someone would need to review the terms of your trust to tell you. I would be willing to review your trust at no charge. If it can be amended, the changes you are talking about could easily be made. Please feel free to contact me if you have additional questions or if you would like to schedule a consultation.

What should I do if my trust that was left to me by my grandfather has been embezzled by two trustees and an attorney I hired?

Answered by attorney Bernard H. Greenberg
Estate Planning lawyer at Kokish & Goldmanis, P.C.
First, you can contact the authorities. Second, visit with an attorney specializing in trust litigation. The local Bar Association is a good place to start your search for an attorney. You might start with someone who is a member of the Trust & Estate Section of the Bar Association.

Is it possible to contest this will?

default-avatar
Answered by attorney Richard J Kaplan (Unclaimed Profile)
Estate Planning lawyer at Richard J. Kaplan, P.A.
Not really. There is no Will giving you any rights. Your parents would have better standing than you to contest the Will. However, since he was survived by a daughter, without a Will, she would have gotten everything anyhow, being the closest relative to him. So the Will gives something to his siblings that they would not have otherwise received without that Will. It probably wouldn't be a good idea for them to contest it either because of this.
