There is no "standard practice" for something like this. It sounds very reasonable for what it appears the attorney will be getting himself involved in.

File a complaint with the State Bar of California against both attorneys. As to proceeding with an attorney, sounds like to me you still will need an attorney to complete the administration of the estate. Figure out a way for all of you to come up with the money to pay the attorney to complete this process.
