How do I leave everything to my kids?

Answered by attorney Monica H. Donaldson Stewart
Estate Planning lawyer at Donaldson Stewart, P.C.
You are generally entitled to dispose of your separate assets (e.g. premarital or inherited) however you choose; however, in order to do so, it is advisable to create an estate plan that makes your wishes clear. I recommend you consult with an attorney to discuss your wishes in greater detail.

How could I deny property inheritance?

Randall C. Romei
Answered by attorney Randall C. Romei (Unclaimed Profile)
Estate Planning lawyer at Ashcraft & Ashcraft, Ltd.
With a timely filing you are able to disclaim an inheritance. The estate would transfer the property to another heir or if none accept the distribution the estate would remain responsible and eventually the property would be foreclosed upon by a lender or the condo association.

Can creditors collect after your death? Must a will be probated? Can I do it with a lawyer?

default-avatar
Answered by attorney Geoffrey N Germane (Unclaimed Profile)
Estate Planning lawyer at Kirton & McConkie A Professional Corporation
Creditors can collect after a person's death-they generally must file a creditor's claim against the estate within a certain period of publication of a notice by the executor. Specific rules will apply to secured debts like home loans. A will does not necessarily have to be probated-if a person wants to begin the 90-day period in which a creditor must file a claim or lose the claim, the will must be probated and a personal representative/executor must be appointed. A lawyer is not necessary but can provide great value in the administration process. Kind regards, Geoff N. Germane
