Does she have a right to sell the home and keep the money from the sale?

Answered by attorney Darin Christensen (Unclaimed Profile)
Estate Planning lawyer at Bullivant Houser Bailey PC
In Oregon, she would have the right to sell the home to take care of your mother's needs. However, the sale proceeds would have to be deposited in your mother's account not your sister's.

What are my rights to a property if there is no formal document from my grandfathers will?

Answered by attorney Brian Chew
Estate Planning lawyer at OC Wills and Trust Attorneys
Unfortunately without a living trust owning the properties owned by your grandfather, your Mother will not be able to sell or distribute the properties until she is officially appointed as the executor by a probate court. It is too late for a trust to be created. She should probably consult with an attorney to have the probate opened. Once she is appointed executor she can sell the properties but if there are other owners she may would have to go to to court again in order to force the sale.

What is my Sister's Entitlement if she is not named in her husbands will?

Answered by attorney David Goldman
Estate Planning lawyer at Law Office of David M. Goldman PLLC
This is a complicated issue, generally a spouse is entitled to the jointly held assets and a life estate in the home. Certain other government benefits depending on the length of the marriage and have have some rights created by contact. In addition, if elected timely, the spouse may claim an elective share instead of the probate assets. In Florida, this is 30% of the elective estate, which again is different than the assets subject to probate. Your Sister should contact a Florida Estate Planning Lawyer to review the assets, options, and help guide her to make the decision that makes the most sense for her.
