This is a difficult question question because it'll probably cost more to get an attorney to represent you than you will recover. however that is what you need because if your brother doesn't have authority to do that without applying to the probate court.

I don't know. You will have to talk with a local probate attorney. Without a will chances are you are entitled to one-half to all of the property, but it depends on your state's inheritance laws.

You probably need to file in the probate action. I urge you to speak with an attorney and provide copies of all of the paperwork that you have. The attorney will probably need to review the court file.
