Whoever the Will gives the house to can sell it without having to put the Deed in their name first. Your lawyer and certainly the Title Company know this and how to word the transaction.

How does one stop a court proceeding?

You cannot stop a court case. If it is in the wrong jurisdiction however, and you are within the proper time limit and have not subjected yourself to the jurisdiction of the court, you can do a Demurrer based on jurisdiction and likely get the case dismissed. However, all this will do is tell the person where to file in the proper jurisdiction and you will end up in court again.

My mom, my ex and myself own a duplex . My mom lived on one side is on other. Mom died leaving her half of duplex to boyfriend. Can I contest ?

If the will was properly executed, unless you can prove that the boyfriend coerced or unduly influenced her into leaving him her half of the duplex, you probably cannot contest the will- especially if there's a no-contest clause, which would generally provide that you lose your share if you challenge the will. It is important to have the will or a copy reviewed by an attorney to make sure it was properly executed.
