What do I do to keep the land in our family as the deed states?

In general, the law will not support restraints on alienation. People own land, and usually they are free to sell the land. It is possible to put deed restrictions on land, but not "forever." The words "to have and to hold by the grantee forever" and the like are ancient forms which used to be required I'm talking England after Magna Carta. You could have a lawyer investigate particular transactions.

How do I add my children’s names to the title of my house?

Estate Planning lawyer at Law Offices of Phillip Day, P.L.
Prepare a new deed. However, you may not need to depending on what you are trying to accomplish. I would highly recommend speaking to an estate planning attorney and discuss your overall objective. Florida homestead rules may come into play and you may not need to do anything. Also, by adding your children to your title, you will be creating gift tax consequences and built-in capital gain issues for your children. Doing things in a vacuum may trigger the proverbial can of worms so tread softly and get some good guidance.

Is probate lengthy or hard? Wouldn't it be good, to leave her checking account open so medicare and champus (sp?) can be auto-paid?

Answered by attorney Jayne L. Sebby (Unclaimed Profile)
Estate Planning lawyer at Jayne L. Sebby
If the estate is small and there is a will, probate doesn't need to be lengthy or difficult. Probate protects the estate by giving creditors and debtors of the estate deadlines by which they have to act. I would recommend that your mother's accounts be kept open unless the power of attorney document specifically permits your brother to close and/or consolidate accounts.
