JTWROS will pass to the survivor of the two of you when one of you dies - no probate.  The better approach would be to have both of you place your interests in your own revocable trusts.  Then you can have your share go to whomever you wish, and your mom can do likewise, and there still will be no probate.  Placing assets in a trust will "break" the joint tenancy, so the trust must say to whom the property is to pass should the settlor of the trust die.

I think your sister has a tough case. Essentially, the three of you own the property, even though title is held by the trust. That being the case, any one of you is entitled to possess the property and you should not need to be required to pay rent to yourself. There are practical benefits in your being at the property, including the ability to safeguard the asset and to keep it insured. Without someone living there, the insurance would have increased in a cost a great deal. There is also the issue of notice. Since you were never informed of the rent, you did not have the right to decide whether or not you would continue to reside there, in light of this expense. It will be far cheaper for your sister to give up on this, than to fight you in court. Another issue is determining what a fair rental price would be. Property values are severely under pressure in Michigan, and there are so many properties on the market, that determining a fair rental price would be very difficult. For all of these reasons, your sister should drop this idea. You would be entitled to 1/3 of the fair rental value, anyway. So we are not talking about a large sum of money.
