If you are listed as beneficiary on your spouse's life insurance and it is payable directly to you upon his death, it will not be included as part of his estate and creditors shouldn't be able to get to it.

Your father does not have an estate unless he is dead or has been declared incapacitated by a court. You can act as the administrator of an estate from out of state if you name an attorney as your local agent. The court may prefer a local administrator, if one is available and not disqualified to serve.

Does your mother's Will address her remains? Does it dispose of them to anyone? Who is named to serve as her Executrix/Executor. If it is her mother, you will have a difficult and possibly unwinnable battle. If not, then you may have a better chance of success. In either event, I suggest that you speak with a probate attorney about the issues, possible remedies and costs associated with bringing an action to recover the remains.
