How do I get money from my mother's account if I am the beneficiary?

Answered by attorney Monica H. Donaldson Stewart
Estate Planning lawyer at Donaldson Stewart, P.C.
The answer to your question depends on several factors. For example, are you named as the "pay on death" beneficiary of the account? If not, did your mother leave a Will? Are you the only beneficiary of the estate? If there is no Will, the size of her estate may affect whether you will need to open a probate to collect the account or whether you can do a simplified proceeding. I recommend you speak with a probate attorney to discuss the answers to your questions and determine your options.

Is it necessary to have an attorney to do last will and testament?

Estate Planning lawyer at Douglas A. Tull, P.C. Attorney at Law
If you live in Michigan, check with your legislator and ask about Michigan's statutory will - he or she should be happy to provide the form to you. That said, a one size fits all form does not necessarily accomplish all that a person will want to accomplish in an estate plan - and a will is only one part of a proper estate plan.

Will the IRS take the home left to my brother in a will? How?

A complicated Will leaving it to him in a trust for his benefit will better protect the house against the IRS (and any other creditors he may have).
