You can refuse to accept your inheritance of the condo. If your mother's will lists someone else as the recipient of the remainder of the estate, that person would inherit the condo. If none of your mother's heirs are willing to accept the condo, check with an estate attorney in the state in which the condo is located to determine how to dispose of it.

Yes, if the surviving spouse does not apply within the period allowed after death (the time period is very short, like 20 days) then one of the children can apply to be personal representative. The child would need to retain counsel.

If you would like your cousin to inherit your home if you pass on, you should have a living trust created and place your home within the trust so that your cousin can avoid the high costs and delays of probate. Also be inheriting your property, your cousin will be given a stepped up basis in your property and thus receive the most favorable tax treatment.
