I want to sell my parents house but my mother refuses. What options do I have?

You can petition a court to break the trust but you'd probably still need your mother's permission to sell the property if she's the named beneficiary. Or you can let the house be foreclosed upon by the mortgage companies who will sell it and use the proceeds to pay off as much of the mortgages as possible.

How can land be divided up between family members when there isn’t a will?

Michael N. Stafford
Answered by attorney Michael N. Stafford (Unclaimed Profile)
Estate Planning lawyer at Law Office of Michael Stafford
The grandchildren as the descendents of the grandfather would have the right to inherit the property pursuant to a Probate court order. One of the heirs would have to petition the Kentucky probate court for an order. I would consult with an attorney to determine your rights to the property.

Can we force subdivide our property?

Answered by attorney Nathan James Wagner (Unclaimed Profile)
Estate Planning lawyer at The Law Office of Nathan Wagner
You will have to work with your sister to subdivide the property. You can force the sale of the property, with the sale price being divided 50/50. But you will need your sister's cooperation to subdivide. You should talk to a local real estate lawyer about how to do this.
