Estate Planning lawyer at Gerald A. Bagazinski
It depends, who is the house titled to? IS there a will or trust. If none, then it goes to their children in equal shares.

How can i get my father's paintings back from my cousin?

Answered by attorney William R. Pelger
Estate Planning lawyer at Pelger Law
If you were his closest heir you would be in a position to not only inherit but to be executor. I would consult with a local estate attorney. He could write this person and if necessary help you open an estate. Once the estate is open these items would be, based on what you say, be estate property and she could be prosecuted for keeping them.

Will the IRS take the home left to my brother in a will? How?

Not wise to home in brother's name. Check with a probate estate planning attorney and your accountant for tax implications.
