Generally Yes you may..However, it is usually set up as a trust.. with a trustee that monitors the gift with alternate instructions if they do not stay in school. It is very typical to allow the trust to pay for the schooling and release the rest afterward or to indefinitely delay the gift (say to age 35 or 40) if they do not continue in school.

Is there anyway to secure a loan from wife to husband and still obtain a refinance in husband's name?

Wife can probably use a deed of trust to secure the loan to her, but this will likely prevent the refinance; it appears that husband does not qualify to refinance with the loan being in excess of the equity. This is why the mortgage broker wants the wife to say she has no interest, or at the very least subordinate her interest to theirs.

HE could get it signed and witnessed. I would point out the effective date of the Michigan Estate and Protected Individuals Code is April 1, 2000. Which means that your will was prepared under the Revised Probate Code. I would recommend that an attorney review these documents for any changes in the law.
