Am I allowed to have my beneficiary be foreign and live in a foreign country?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Kimberly D. Moss, PLLC
Yes, your beneficiaries can be any one that you choose. However, you want to make sure that whoever you name as the executor of your estate knows where and how to find your beneficiaries so that if you pass away, your executor will be able to easily contact your beneficiary so that he or she can get their share of inheritance. For specific advice about your estate plan be sure to contact a local attorney.

If my father planned for separation, does this factor into her claim?

Answered by attorney Ronald K. Nims (Unclaimed Profile)
Estate Planning lawyer at Ronald K. Nims
Ohio only recognizes a persons matrimonial status to be 1. Married or 2. Single. As long as he was married to your stepmother, she qualifies as his surviving spouse and is entitled to 1/3rd of his estate. However, if they had a written or court ordered separation, that takes away her inheritance rights, that would void her rights to any part of his estate.

Do I have to leave each child something when I do my estate planning?

default-avatar
Answered by attorney Sherrie Lynn Davidson (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Sherrie L. Davidson LLC
You do not have to leave anyone anything. However, each child should be specifically named to Show your intent that they receive nothing rather than saying nothing about them. This ensures your intent and not that they were mistakenly left out.
