If a person whom has POA dies before the person whom he has POA, does the POA go to the executor of the deceased estate to appoint another?

No. If the POA document doesn't name an alternate agent, then the principal will need to name a new one. It the principal is now incapacitated, you're probably looking at guardianship and/or conservatorship.

What can be done if Dad passed away and his sister took all of his assets?

Answered by attorney John F Brennan (Unclaimed Profile)
Estate Planning lawyer at Musilli Brennan Associates, PLLC
You should engage an attorney to look into the circumstances for you and advise you of your legal rights. Generally, under the laws of the test to see you would be the presumed heir to what ever your father died ceased of. If on the other hand he died with a will leaving it all to his sister you may be entitled to little, if anything.

Can I be in control of the trust and not be able to touch it?

default-avatar
Answered by attorney Norman Harry Green (Unclaimed Profile)
Estate Planning lawyer at Irsfeld, Irsfeld & Younger LLP
"I have a trust that I can't touch." What does this mean? Every trust has three parties: Settlor (or Trustor) who forms the Trust and puts something into it. Trustee who manages the Trust Estate. Beneficiaries who get the economic benefit of the Trust. It is certainly possible for you to be trustee of a trust from which you are not authorized to take distributions for yourself. Guardians are for minors only.
