Can sister in law sue for part of estate? Mother dies, has 1 son on a stipend, sister is trustee. The first son dies, had been supported for life.

Answered by attorney Mitchell Allan Port
Estate Planning lawyer at Mitchell A. Port
No, the sister in law probably lacks standing to bring a lawsuit.  She can sue, but she'd probably lose.  She doesn't get anything through her deceased husband unless the will or trust provides for her.  You ought to retain an attorney since it could quickly spin out of control.

Person "X" needs to consult with an attorney who can review the entire document. It is very dangerous to answer a question on facts out of context.

What will happen to my father's properties, social security and pension if he doesn't have a Will?

You don't mention the nature of the properties, or when they were acquired. As to the pension and social security benefits, seek the assistant of an attorney who specializes in social security matters and pension claims.
