Do I have to sign anything at all?

Answered by attorney Marcus William Kroll
Estate Planning lawyer at Kroll Proukou, LLP
If you refuse to sign a receipt / release or consent to probate, you will be cited to return to court on a specific date. If you refuse to appear, you will "default" which will act as a consent without having to sign anything or appear anywhere.

Any co-owner can bring a proceeding in court asking for a partition, which means either dividing the property if it's capable of being divided (for example, farmland), or compelling a sale.

How do I update my will?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
You can either replace it with a new Will or, if you are only making small changes, amend it with a Codicil.  A Codicil must be executed with the same formality as a Will.  Contact a local estate planning attorney to make sure it is done right.
