The brother who does not want his interest in the property needs to sign a quit claim deed over to you (or directly to the charity) relinquishing his interest in the property. If he quit claims it to you in your capacity as Executor, then you can then deed the property to charity or to a third party.

Even if your mother had signed a power of attorney before she died, it became invalid the moment she passed away. A power of attorney ends at death. At this point, you would need to be appointed executor (if she had a will) or administrator (if she did not have a will) in order to take care of her estate.

What you can do with a will or trust or other estate planning belongs entirely to you. With a will, or a trust or other estate planning, your estate could be divided equally among your surviving children. Using the authority you have to punish or get even with one or more of your children may not be the best choice but it belongs to you. You cannot be put out of your own home. You need to consult an attorney about that immediately.
