The insurance company almost always will go with whoever is designated with their beneficiary designation form. It sounds like you are the beneficiary of the insurance. If your father meant to add your brother as a beneficiary, but did not do it, then the letter is not going to change anything. Of course, if your father wanted your brother to share in the insurance proceeds, you might feel an obligation to do what your father wanted, but you would be making a gift to your brother to achieve that.

If you feel a trustee has wrongfully withdrawn funds you should first file a petition in court to have the trustee removed and held liable for his actions. Depending on the severity of the conduct and the amount of money, you may be able to get a District Attorney to file criminal charges for fraud or embezzlement. But normally these issues are handled in Probate Court.

It is advisable that you have what is commonly called a "pour over" will prepared along with the revocable living trust. This is to be utilized as a catch all in case an asset is not properly placed in the protection of the trust at the time of your death. It would be extremely unusual for an attorney to prepare a revocable living trust without also preparing a pour over will.
