The wrinkle here is the mothers rights in the property..if papa has given all his property to one son that is his right and the other sons have no rights after he dies. However if mama retains rights in the property that is the question mama may have dower rights over real property so.

The custodian must deposit the will within 10 days after receiving information that the testator is dead with the Clerk of the Court where the testator died (in this case the Clerk of Palm Beach County). If the custodian fails to do so, an interested person may file a petition to compel the custodian to produce and deposit the will. A probate attorney should be able to determine if probate is necessary after an in-depth evaluation of all the pertinent factors. There are a lot of different variables to consider when determining whether probate is necessary, and if so, which proceeding must be commenced. Good luck!

You may have bigger issues than you think. You would need to show by clear and convincing evidence that he intended to give you the home or face an elder abuse case through the attorney's general office. He can also sue you for two times the value of the home, plus the home. You should speak with an attorney to see if those are viable actions against you. You may just want to give the house back. Again speak with experienced elder law counsel on these issues first, but those are the cold hard facts.
