How long does a lawyer have to notify the heirs of a will details contained within the will?

Eric James Smith
Answered by attorney Eric James Smith (Unclaimed Profile)
Estate Planning lawyer at Law Office of Eric J. Smith
There is no requirement that a will be probated. A person named executor in a will must probate the will to act in that role, and then they must qualify to be executor. If you think there is a will and you think you should receive under it, contact an attorney. The probate process relies on interested parties to act.

Do I have to leave each child something when I do my estate planning?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Estate Planning lawyer at Peters Law, PLLC
Nope. I do like to put a statement in the wills I draft that the testator chooses not to leave anything to the child. That way, there can be no claim that you forgot them. It is your money and your assets, you can leave it to whomever you want.

You need to hire a lawyer to sift through all the facts you have presented in order to figure out whether or not you have a actionable compaint.  The longer you wait the harder it will be, if possible at all, to unwind anything.  Again hire a lawyer.
