One of the grandchildren should open a probate in the state of Kentucky and obtain court authorization to administer the estate. As administrator, he or she can sell the property on behalf of the estate. Proceeds net of costs would be then be accounted for and distributed equally among the grandchildren.

First obtain the services of a probate litigation lawyer to represent you to review the documents you have and make an analysis of your potential rights of distribution of your mother's estate. You may want to read probate code section 850 which relates to lawsuits for heirs who may have been left out of the will of the deceased, among other things.

File a Petition for Probate to force him to come forward with the will. He will then file a Petition for Probate and once it is in probate you can demand an accounting. If it is a small amount of money it will be more difficult because probate may not be required. Speak with a local attorney to get some advise.
