A power of attorney is no longer valid once the person who signed the power has died. Even if your mother had signed a power of attorney, then, it would not help you now. It's not possible to tell you what to do now, without receiving more information. You may have to probate your mother's estate, or there may be a way around probate. The question depends mostly on the size of your mother's estate. You can do some reading on the subject of probate, you can talk to a lawyer who handles probate matters, or both.

Her claim may in fact be for her one-half of the community property. In Louisiana, each spouse owns one-half of the property acquired during the marriage through the efforts of either spouse. (Gifts and property owned by the marriage are not included.) Since she would be the owner of that one-half, it is not considered part of your father's estate. As far as your father's property is concerned, the will would control, to the extent it is not in conflict with state law.

I'd have to review the will and dates of death. Without knowing your entire story, my typical advice is: you should get a family settlement in place, probate the will and be done with it.
