You need to go into the probate case and get an order requiring her to give you and your siblings your belongings. Talk with the probate attorney about it.

Unless, there was a document stating that the monies given to the mother were loans, it is probable that a court would interpret them as gifts to the mother and not repayable from the proceeds of the estate. However, unless you are talking a lot of money, it may not be worth the trouble to pursue.

Your father absolutely must do the estate planning, or the value of the business may be lost to your family. He should not only have a will, he needs a "buy-sell" agreement with the other shareholder, stating what happens when a shareholder passes away.
