My Mother has 5 children. She split ownership of her house into 3rds. How can we all be assured that the sale will be shared equally to all 5 kids.

If the house in in joint tenants with right of survivorship, and your mother dies, the house will go to the two sisters, and there is nothing you can do to make sure that the other siblings receive a share of the house.  If the house is owned as tenants in common, all of the siblings will inherit mom's 1/3 shar eof the house, but again, there is nothing you can do to make them give you any portion of the proceeds.

My mother owns a home which in the will states all assests divided equally between brother and myself 50/50 when she passes on. I live with her

I'm not sure if you are asking if you have to pay all of the taxes when your mom dies, or now.  When your mom dies the Estate will be responsible for paying taxes on the house until it is transferred into you name and your brother's name.  The Estate will consist of all of your mother's assets, other than the house, and the money that is in the estate will be used to pay all of her last bills, and costs associated with administration, etc.  One thing you should keep in mind, if you live with your mother, and she ever needs to go into a nursing home, the house is an exempt asset and can be transferred directly to you.

If the money in the account is in your name, then it is not part of the estate.  Ther eis something called an "account of convenience" where someone adds a name to an account to make it more convenient to write checks.  However, if the account is solely in your name, I don't see how your mother can make a claim to it.
