If my husband had a will prior to our marriage, what am I entitled to if he passes away before he changes his will to include me?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
That is a complicated questions. It depends upon many things, i.e., does he have a trust, what are the value of the assets that would be subject to probate, do you have a prenuptial agreement? I urge you to speak with an attorney as well as your husband. This information is only intended to give general information in response to an inquiry. It does not establish an attorney client relationship. Is my father liable for all the medical bills addressed to my mother after she passed away?

default-avatar
Answered by attorney Susan Goodkind Wideman (Unclaimed Profile)
Estate Planning lawyer at The Wideman Law Center, P.C.
If your mother died with assets in her name alone, then her Probate estate may be liable to pay those bills. If all of your mother's assets passed to your father or others without Probate, then he should not be liable for her bills unless he signed agreements or contracts indicating that he would pay her bills when she was receiving her medical care.

How do I remove a name or a deceased person (niece and her heirs) from my will and revocable living trust?

default-avatar
Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
No, you should never cross out provisions in your documents, because this could inadvertently be considered a revocation of the documents. It is possible, if the documents are properly worded, that nothing needs to be done, at this time. The documents should clearly state what happens if the named beneficiary is predeceased. If it is not clear what happens, you should contact your attorney and clarify this issue. It is relatively rare that this would require amended or new documents.
