Evicted no, but he can force the sale of the house and would have to do that through a partition action, or if the property is actively in probate he may be able to get a court order there since you are not the owner yet, the estate is. You can always buy him out of his 1/2.

Son needs to contact a probate attorney in the county where the property is located in Colorado or where the decedent died, to commence a probate proceeding to obtain an order transferring title to the property to him pursuant to the terms of the will.

Without a will, you will each be deemed to have predeceased the other, so your estates will go to your heirs. Assuming there are no other children, they would probably be divided 3 ways with your children. Life insurance is a different matter. If you want some of your estate to go to charity or somebody else, you will need to make a will to provide for that.
