What do I do to be able to stay in my grandma’s house even after she passes away?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
First, get a job and find a way to support yourself. The law is not going to preserve your right to live off someone else. At your age, you should learn to fend for yourself. Then, if your grandmother is being influenced by your aunt, find an attorney who can get a conservatorship over your grandmother to protect HER interests. At the end of the date, it is about her life being lived without stress and concern, not about the family fighting over there perceived "right" to her money.

What can I do to fix the will of my father?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
I am sorry to hear of your loss. If your father had an estate plan that was valid that did not include you, then you would be entitled to nothing. If the estate plan may legally challenge then there is a possibility that you may be an intestate beneficiary. Since it does not appear that you know whether you are a beneficiary or not, you should probably advise the persons you believe to be the Trustees of your father's death and request a copy of the trust in writing, unless it is given to you based upon an oral request. Once you either receive the trust, or are denied the trust you should speak with an attorney in the State where your father died to help you determine your rights and next steps.

Am I still a beneficiary because my brother was appointed executor for my mother's estate as well as my grandmother's?

Randall C. Romei
Answered by attorney Randall C. Romei (Unclaimed Profile)
Estate Planning lawyer at Ashcraft & Ashcraft, Ltd.
The validity of the Will could depend upon the circumstances surrounding the preparation and execution of your grandmother's new Will. The facts and the ability to prove the facts are important. Did your grandmother understand what she signed? Was she misled. If your mother died after your grandmother, then, as the beneficiary of your grandmother's estate, your mother's estate will receive its proper distribution pursuant to the terms of your Grandmother's Will. You must then look to the terms of your mother's Will to determine who would receive her estate. If your mother had no Will then your mother's children share in the distribution of your mother's estate. If your mother predeceased your grandmother, then the contingent beneficiaries under your grandmother's Will receive the distribution of your grandmother's estate.
