How can I guarantee that all the assets my spouse inherited from our marriage go to our child and not to the new spouse if I die first?

You can create a will that leaves everything to your child(ren) and name someone else to serve as trustee for any children who are still minors at the time of your death.

Do I need to do anything or will New York simply take the remaining $13,800 in her remaining checking account?

Answered by attorney Joseph A Marra
Estate Planning lawyer at The Law Offices of Joseph A. Marra, PLLC
I am sorry for your loss. If nothing is done then the funds will eventually escheat to the State of New York. It is unfortunate that all $300,000.00 was spend on nursing home care. With proper planning she could have gotten Medicaid benefits much earlier and at least $100,000.00 could have been preserved and passed to family members.

Will the IRS take the home left to my brother in a will? How?

Yes, the IRS will take the house. The most obvious way around this is to put the house in a trust, so your brother can live there but not own it.
