Can your legal fees be recovered in a contested Will case if you win in court?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
Attorney fees are rarely granted. This however is a question you should be discussing with your attorney. He can make efforts to get attorney fees or some other punitive damages if properly pled.

What can I do if my father dies in another state in 2011 and my sibling intentionally withheld information and gave items away against will?

Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
I believe that, if you are going to assert the Will as your basis, this will have to be a probate. Was your father a resident of another state, or did he just happen to be there, visiting or on vacation? Did he own property in Oregon? If he's a resident of another state, then you would have to probate in the other state.

If my daughter gets a divorce, can her soon to be ex claim half of her share of the property?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
No unless community property of their marriage has been used toward the property, then he may have an interest. Otherwise it is separate property and he would have no claim to it.
