The Personal Representative of an estate, if duly appointed by the Court, has full authority to deal with all property owned by the estate. This would include the legal ability to lawfully evict tenants or occupants of property owned by the estate.

The rules for summary judgment are contained in the local rules of court of the particular county you reside in and in the code of civil procedure; the rules are very onerous and I would suggest you seek a civil trial counsel as to how they work and be applied in your case;, but the purpose is to shorten the case process through court, by obtaining an order the plaintiff does not have any or sufficient facts to support the law he is attempting to use as proof of his case; the same rules apply to defendants when they do not have sufficient facts to support the defense they are alleging against the plaintiff's action.
