In a community property state such as California, 100% of your community property is available to creditors for either of your debts as well as the separate property of the debtor. It does not matter whose name is on the account as any funds which originated from the money you earned from your job since you have been married is considered to be community property. The only way to protect up to half of the community property is to divide your assets into separate property via a transmutation agreement. However, the debtor spouse must receive at least 50% of the community property in order for the agreement to stand up to the creditors.

First I will assume that he was not married to one women and that he had a girlfriend on side. If that is the case, the wife would have rights. Assuming you were 18 or older when your unmarried/divorced dad died and he was competent when he made the beneficiary designations, he could leave his assets to whomever he choose, be it a girlfriend, boyfriend, charity, or family. There is no requirement that he provide for an adult child.

Sounds like your husband should hire an attorney to review the situation and advise him of the risks. Not only could it be what they are claiming but it may subject himself to a criminal charge for abuse of the elderly in Florida.
