I have joint tenancy with rights of survivorship with my mother. Can she quit claim her interest to someone else before she dies?

Answered by attorney Charles Richard Perry (Unclaimed Profile)
Estate Planning lawyer at Charles R. Perry
Yes. A joint tenancy does not restrict in any way one's right to transfer their interest in the land. If such a transfer occurs, you and the grantee would hold the property as tenants in common.

If a spouse dies and has stocks and 401K who gets control of that?

default-avatar
Answered by attorney Nathan James Wagner (Unclaimed Profile)
Estate Planning lawyer at The Law Office of Nathan Wagner
It depends. The stock brokerage company and the company that manages the 401k probably asked the deceased spouse to designate a "beneficiary" who would receive the accounts. The beneficiary would then get the accounts. If no beneficiary was designated, then the deceased spouse's will would determine who receives the accounts.

Can people threaten me about selling my house if the title deed is on my name?

Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
Your situation sounds very strange. I do not see how they could do anything with your house, since only you are on the title. If there were claims against your husband, those claims may have died with him. You need to have all of your facts and paperwork reviewed by an attorney to determine where you stand.
