You have not stated whether your father's estate has been presented for probate.  The appointment of an executor or administrator delays foreclosure for six months.  If the lender then forecloses, it takes the property with all debts associated with it.

My Mother has 5 children. She split ownership of her house into 3rds. How can we all be assured that the sale will be shared equally to all 5 kids.

If the house in in joint tenants with right of survivorship, and your mother dies, the house will go to the two sisters, and there is nothing you can do to make sure that the other siblings receive a share of the house.  If the house is owned as tenants in common, all of the siblings will inherit mom's 1/3 shar eof the house, but again, there is nothing you can do to make them give you any portion of the proceeds.

The realty is owned as tenants in common by husband and wife. When the first spouse died no estate tax was filed and the will was not probated.When

There is no estate tax between husband and wife so no estate tax return would have to be filed.  I'm not sure why you are concerned about who gets what share if both spouses are dead.  Were the wills of each person different?  Is the disposition different?  Or is the concern did the whole house pass to the surviving spouse, and then the surviving spouse's will governs what happens to the house?  If you have more information, please feel free to call.
