Can we stop future purchases on credit other than doing a conservatorship?

Estate Planning lawyer at Law Office of Victor Waid
You could use a durable power of attorney, giving you the power to act on his behalf but it is not as effective as a conservatorship, because it is revocable anytime by your brother. You need to obtain the conservatorship of his person, if you want to have control of his actions.

Can the executor of a trust move accounts out of the trust that are designated to other people?

Obtain yourself a probate litigation attorney NOW to bring a petition for an accounting of the assets of the trust, and to whom paid, and when paid, and have removed as executor/trustee from the trust and to force her to produce the assets to have the assets placed back into trust. She may have committed embezzlement, which is re-portable to the District Attorney for prosecution. This is urgent.

Can a Power of Attorney be used to manage trust assets?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
The successor trustee has all of the power for trust assets. A power of attorney is not sufficient. Look to the trust. If she can appoint you as successor trustee that will work. The terms of the trust will control.
